There have been no signs of any such
action on his patt as yet, and, in the interim
Mr Heermann has ohnaged his domicile to a house in Kowloon on the mainland. His former residence near Mount Davis is now occupied by two other Germans of different firms.
On the 12th August, after taking the advice of H.E. the Governor, I consulted the Crown Solicitor as to what action could be taken under the amended Ordinance. It appears that as
Mr Heermann was not committing an offence by being in possession of plans on the 5th November 1910, the only way in which he can be dealt with is by the issue of a search warrant against him on the ground that evidence shews that he had plans in his possession on the 5th November. Such search might not result in the discovery of the plans in his possession, as he may possibly have got rid of them when the new Ordinance was passed. Under such a contigency the position would be an unpleasant one, and would lead to ill feeling among the Germans in the Colony, and possibly to more serious trouble.
I request instructions as to what,
if any, action should now be taken by me in the
matter.
